Rent-to-own can give some El Paso buyers additional time to prepare for a mortgage while living in a home they may eventually purchase. But these agreements are more complicated than a normal rental and can involve significant financial and legal risks.
While every agreement is different, a typical rent-to-own transaction may follow these steps.
The owner must specifically agree to a rent-to-own structure. A normal home listed for sale is not automatically available for rent-to-own.
Buyer and seller negotiate rent, purchase price, option period, option fee, maintenance responsibilities and other terms.
The lease and purchase option or purchase obligation should clearly describe the rights and responsibilities of both parties.
You occupy the property and make the required payments during the agreed rental or option period.
If the agreement allows and you qualify for financing, you may exercise the purchase option and complete the purchase according to the contract.
These phrases are sometimes used interchangeably, but the obligations can be very different.
A lease-option generally gives the tenant an opportunity to purchase the property during a specified period, subject to the written agreement.
Some agreements may obligate the tenant-buyer to purchase the property rather than merely giving them the option.

Suppose a seller and tenant negotiate a two-year lease-option. These numbers are only an illustration — they are not typical, recommended or guaranteed terms.
If the agreement provides a $200 monthly credit and all conditions are satisfied, 24 months could potentially create $4,800 in credits. However, the contract determines whether credits exist, when they apply and whether they can be forfeited.
Rent-to-own is not automatically easier or safer than purchasing with a traditional mortgage.
Option consideration may be nonrefundable. If you decide not to purchase or fail to comply with the agreement, you could lose it.
Do not assume part of your rent goes toward the purchase price. Credits must be specifically provided for in the agreement and may be subject to conditions.
A rent-to-own contract does not guarantee mortgage approval. Credit, income, debt, interest rates and lending requirements can change before you are ready to purchase.
If the purchase price is established today and property values decline, you could agree to pay more than the property's later market value.
Even if you agree on a purchase price, a future lender may require an appraisal. A low appraisal could affect the amount the lender is willing to finance.
The owner may have a mortgage, tax liability, judgment or other title issue. Buyers should investigate title before committing significant money.
Some agreements shift maintenance or repair obligations to the tenant-buyer even though the tenant does not yet hold title.
Late payments or other breaches can affect the option to purchase and may cause the buyer to lose money already paid.
A seller's mortgage or other financial obligations can create complications. Buyers should understand who owns the property and whether liens exist.
Texas law can treat an option to purchase residential real property that is combined with a residential lease as an executory contract for conveyance of real property. Texas Property Code Chapter 5 contains important requirements that may apply to these transactions.
Depending on the structure and timing of the agreement, the law may address matters such as disclosures, written agreements, recording, accounting, default procedures and other buyer and seller rights.
Because the legal effect depends on the actual documents and circumstances, buyers and sellers should consider having a qualified Texas real estate attorney and title professional review the transaction before signing.
A careful review can help identify problems before you invest money into the transaction.
Rent-to-own is only one potential path toward homeownership. Other options may be worth comparing before making a decision.
Some El Paso sellers may consider financing the purchase directly rather than requiring a traditional mortgage at closing.
